Probate & Estate Administration

At Sekel Grinberg Leggat, we understand that managing the affairs of a loved one following their passing can be an emotional and challenging experience.

Our experienced estate lawyers provide clear, compassionate and practical legal guidance to executors, administrators and beneficiaries throughout the probate and estate administration process.

We assist with straightforward estates through to complex matters involving substantial assets, trusts, business interests, property holdings and competing beneficiary interests.

How We Undertake Probate Matters

Our approach is designed to make the probate process as straightforward and efficient as possible, while ensuring that executors understand their responsibilities and receive appropriate legal support.

  1. 1
Initial Consultation and Estate ReviewWe meet with the executor or family representative to review the deceased’s Will, identify the estate’s assets and liabilities, and explain the legal requirements and steps involved in administering the estate.
  2. 2
Preparing the Probate ApplicationWhere probate is required, we prepare the necessary documentation and lodge the application with the Supreme Court of New South Wales. We manage the application process, including responding to any requisitions raised by the Court.
  3. 3
Identifying and Collecting Estate AssetsOnce probate has been granted, we assist executors with identifying, collecting and managing estate assets, including bank accounts, property, investments, shares and other financial interests.
  4. 4
Administration of the EstateWe guide executors through their legal obligations, including addressing outstanding liabilities, coordinating with accountants and financial advisers where necessary, and ensuring the estate is administered in accordance with the Will and applicable law.
  5. 5
Distribution to BeneficiariesOnce the estate is ready for distribution, we assist with preparing estate accounts, transferring assets and distributing inheritances to beneficiaries in accordance with the Will.
